Triggered Again! There is no such thing as IP in the WEB3 era.

Saw another article today about quote "How Intellectual property could be Transferred through the Blockchain Ecosystem". Once again, people just don't get it. They do not see where this is going. They keep asking what crypto can do for the legacy economy when they should be wondering what the world will even look like without it.

There is no such thing as IP.

Intellectual property is enforced by the centralized system we live in today. It can not be enforced in a borderless permissionless world. Just look at China. They unapologetically stole every piece of tech they could get their hands on and no one could stop them.

And they exist within the confines of a single border. What happens when the entity 'stealing' the tech for themselves exists across every country operating from within the digital metaverse? It's going to be mindblowing I can barely even imagine it. I'm am only just scratching the surface in this post. Not even the tip of the iceberg.

Think about Torrents and pirating. We couldn't stop people from "stealing" music and video; why would it be any different with money ownership or branding? In fact, it will be different, but in the opposite direction. Stopping DAOs from "stealing" these things will be a thousand times harder when these networks are enforced across thousands of nodes and dozens of countries. Impossible even. Still, I expect quite the war to happen regardless of the futility of it.

first-amendment-free-speech.png

Attack on free speech.

In the end this is inevitable. Programmers are protected by freedom of speech. Writing code is never illegal (only running code is certain ways happens to be). However, when devs come for everything the legacy economy has and eats the lunch of every billionaire on the planet, what other choice are they going to have? They will have to make this type of expression illegal (or at least try to). Like I said, it's a war they are guaranteed to lose. But I'm sure it will be quite ugly during the thick of it.

At the end of the day I get mad because the vast majority of people do not see what I can tell is painfully obvious. However, this is a "show not tell" situation. We must show the world in definite terms that this is going to happen and there isn't a damn thing they can do to stop it. We must prove it to them, because they are in absolute disbelief that the world could change so vastly in such a short period of time.

Imagine if I create a clone of Cards in Humanity. I have plans to do just that. What's actually stopping me from calling it Card's Against Humanity? A cease and desist order? That's laughable.

My substitute name for this clone will be Magic Words. This is the branding I will use by default. However, what happens if I make a skin for this open source game that changes all the branding back to Card's Against Humanity? What if this skin gets seeded by a torrent on a blockchain and users who seed that torrent get paid in crypto to distribute it to the world?

Who is the legal system going to target in this situation? They can't sue me. I may of created these things but as soon as they were projected into the world I lost total control of them. I am not running a server that calls it Card's Against Humanity. Those versions are running locally on the gamer's computer. I have nothing to do with it.

Normally in this situation I would be running a server or selling a product in a centralized manner that could be targeted. In an open-source WEB3 atmosphere, the entire game gets changed. Again I say, there is no IP law that can be enforced once crypto goes mainstream.

Hack pirate flag.png

Think about all the popular brands and franchises.

  • Star Wars
  • Disney
  • Starbucks
  • Super Mario
  • Star Trek
  • Every patent
  • Every drug
  • Every brand

None of them are safe.

All of them will be 'stolen' by the communities that love them. They belong to the people now. Everything will be hashed and rehashed and there isn't a damn thing the original "owners" can do about it except allow it to happen and help with the development so they don't get left behind.

And that's the funny thing...

We'll all know something is fully decentralized and unassailable if they simply pirate another brand/franchise that everyone already knows/loves. Should we see a blockchain Mandalorian game that has nothing to do with Disney, we'll automatically know it's legit because Disney can't shut it down even though they absolutely would in every other circumstance possible. Something tells me a lot of lawyers are about to become fully obsolete.

image.png

So you've made a collectible breeding monsters game. Gotta collect them all! Do you call it Axie Infinity or Pokemon? Oops, can't call it Pokemon because you have a centralized dev team and a centralized everything else that can get shut down immediately.

None of the projects out there today are doing it right. Not is single one. The infrastructure simply doesn't exist yet and the vision is severely lacking.

Imagine the infrastructure it would take to dethrone Big Tech.
Imagine the infrastructure it would take to dethrone Big Pharma.
Imagine the infrastructure it would take to dethrone Big Oil.
What about the military industrial complex?
What about Hollywood?
What about central banks?
What about government?

They will all be destroyed and reborn as DAOs

Every single one. And it's really impossible to know how that's even going to go down, because it's going to be batshit insane I assure you all. But it will happen, and it will be a thing of legend. We live in the most important transitionary phase in human history. This is why I scoff at all the greed-monsters who are still focused on the money. I'm more interested in saving the Earth from complete obliteration. The cancer of greed has spread itself deep, and if you can't see Armageddon on the horizon then I don't know what to tell you. These are 'evolve or die' chronicles, and we are living them in the present tense.

Conclusion

Imagine writing a post about how an open source tech is going to protect and secure closed source tech. That's what keeps happening over and over again with crypto, because no one seems to get it. No one sees what's happening here. It's all about how we are going to manipulate crypto to suit our needs, and no one seems to realize how crypto is going to shatter and destroy just about everything we know, and it will be a good thing.

"You will own nothing, and you will be happy."

No matter how many times they try to create "enterprise blockchain" or stable coins or CBDC or other "blockchain not Bitcoin" solutions, all they do is showcase their ignorance. The Dinosaurs are just that: on the brink of extinction. Don't let them pull you into the tar pit with them.

There is no such thing as intellectual property in the future. Ideas no longer get to be owned, and that's fine. There will be plenty of other ways to generate value and accumulate wealth without these ridiculous patents who's only authority are men with guns. The future of enforcement is digital, and we are making the shift from negative reinforcement and prison to positive reinforcement and community. It's the ultimate upgrade for society as a whole.

And patents have never protected the people we assume they are meant to protect. The actual inventor.

No, a patent is a $5000 gun, but the bullets cost a million dollars a piece.
Don Lancaster pretty much proved that for an inventor, the patent is useless, less than useless in that, at best, it will cost you a lot of time and money.
Don said, back in the 80s, that the best way to "patent" something was to make a write up and disclose everything in a magazine.

I have always hated the idea of IP, because trying to hold onto an idea while sharing it
... having your cake and eating it too...
is just so absurd, illogical and bad for the world.

Chinese don't care. Copy and say sorry later. Patents are only expensive ( really).

To maintain them in different countries and protect all rights, you can pay fast a lot of money.

IMO, there will be in the future IP´s, that works like subscriptions.

You get updates for subscriptions of future work.

Those versions are running locally on the gamer's computer. I have nothing to do with it.

Konami was doing that for years in PES. they did not have rights to use a lot of club names and players but after some time there will be a patch that will set everything right. it was probably never official but there is a good chance that they did it.

I do agree that it is easy to copy and reproduce just about anything. With technology gets a bit hard to do, but still it is able to be done for those willing to put the time and copy it.

With regards to intellectual property and copying/stealing that.... It could be an argument of personal ethics, such as what type of person would engage in thievery like that and of whom there stealing it from, and to what regard.

Stealing a lifesaving vaccine from a pharmaceutical company to have it mass-produced to save many lives is dairy argue a noble endeavor, Robin Hood style... But stealing someone's hand-drawn work of art, to then minted and solid as your own... That is plagiarism, and while there is nothing stopping someone from doing that, it would then fall to the idea of personal ethics. Yes it is easy to scan and grif people in this method, to claim something as your own and profit off of other people's hard work.. But if everyone in the world does this, everyone is just a thief stealing works from other people... What type the world do we live in?

I could see how, in a hypothetical way, we can make use of the block chain and stamp artwork or code, then if other people freely use that, they would automatically get royalty payments based on smart contracts. Sure there are ways to once again steal things but then there systems in place to help compensate people automatically.

It's a hard question and I think a lot of it comes down to how the individual person wishes to live. Just my thoughts!

Dropping you some hot !PIZZA and !LUV on this post! ❤️

It is like youtube videos. We know they arent posted by the original artist, but we still love them and watch them and the poster may get some rewards. We will know the difference between original and copy

I don't think we will know the difference between a copy or original, unless of course we have them stamped with individual wallets much the same way transactions on the block chain or sign, then we contracted back to make sure the wallet signing that transaction is the original author for that piece of content.

great post! It is really mind boggling to think of all the changes that are coming. I think you are right when you say that this is going to be the greatest transition in human history as it will take a completely different look at how we see and understand the world.

Sccchhhhh. You're going to awake the NFT fanboys! 😂

Ah see that's interesting because we can tokenize ideas and know where they came from but we can't stop anyone from copying it. Still, there will be plenty of money to go around for everyone.

The way we socially reward ingenuity is fucked up. Soo, you just combined some ideas of other people with understanding of nature and you want to be rewarded for this for the rest of your life? STFU, just mint that NFT and opensource the rest! You're not special or genius, congratulations, you just improved conditions for other human beings.

THIS!!!
Ip is just one of the tools used by our masters. It and all the rest of the legacy system must and will fall.
Ip is silly anyway.
If ip lawyers had existed in the stone age we would be renting fire.
Everyone knows this is stupid. Once the enforcers fall all their control mechanisms will just fade away.

Finally im not alone, I have been triggered ever since privacy coins took the back burner to these mainstream bloatware coins that dont really accomplish anything on chain aside from tracking coins. the distributed ledger is cool but now becoming obsolete with the weeb 3.0 stuff and we need to find ways to protect our equity in this transition.

If IP is not going to be a popular topic, then how are creators supposed to be motivated? What incentives are offered to independant artists in web 3.0 in this context?

Its very concerning to see so much FOMO and FUD but no one critically thinking about NFT.

I replied to a popular twitter users status about NFT's and was just spammed with LOL, NGMI, and FOMO about whatever NFT marketplace it was they mentioned. (not linking because I am not promoting for that annoying community).

I dunno, Uniswap seems to be advancing to stop people rehashing their code. I think there is still a place for IP but China been ripping off IP and selling rip off's for years. Same as movies have you watched Transmorphers at the time Transformers came out.

Nothing new, I still think there is a place for IP depending on what it is. Also, the point about cards against humanity you could totally do that now without a hitch. Releasing a skin might cause some issues but like you said who are they going after. Plus not sure why you'd use that when you could create your own brand and do it better.

Patents are a chronic issue especially when it comes to life saving tech and medicines. They're unconditional across many nations and go against basic human rights. Yet governments give them power by adhering to them (opinion).

Well IP is weird. We got copyright laws but they are so outdated and don't fit anything digital. I don't even know if we can adapt copyright to the digital realm since anyone can just copy anything they see if they wish.

IP as we know it won't exist. Blockchain does make it easier for a more "earliest" truth system but as long as humans recognize that the earliest is indeed valuable.
That or DAO funded army to stomp on people for stealing "IP" gets formed lol

I believe that patents are the way to protect Personal Authorship in different areas. If there were no patents, the "economic world" we know today would not exist!

That's exactly the point I'm making:
The "economic world" as we know today is not going to exist.
We better pivot quick or get wrecked.

I see the year 2030 :)

Enjoyed reading this piece!

The future of enforcement is digital, and we are making the shift from negative reinforcement and prison to positive reinforcement and community. It's the ultimate upgrade for society as a whole.

I'm so happy to be involved in this process and finding my ways to contribute more.

Sadly, I think there are still a lot of blockchain based articles out there that trigger a lot of us. We still haven't turned that corner yet were people really get it. It is much easier to continue sensationalizing it and make it as trivial as they can. I think the article I saw about about how STEAM is not going to allow blockchain or crypto based games on their platform. The author was clearly someone who either doesn't get it or is butt hurt because they missed out on investing earlier. It was very snarky and bitter...

All of them will be 'stolen' by the communities that love them. They belong to the people now. Everything will be hashed and rehashed and there isn't a damn thing the original "owners" can do about it except allow it to happen and help with the development so they don't get left behind.

This gets discussed in a crypto context.

For example whether the Ethereum community would ever truly come together to fork out Vitalik etc.

But like you talk about here, everything is going to be open slather soon enough.

We already have parallel internets running with the Chinese version and the global version (lol).

Web 3 will soon make the censored Chinese version obsolete and a web 2 vs web 3 parallel will take its place.

But in the end, all roads lead to web 3 and community ownership of just about everything.

Make your bets accordingly.

This is brilliant. Sorry I'm a bit late. @ZakLudick did you read this? Incredible perspective and actually quite encouraging for a content creator.

Finding the finest proxy service for my requirements will need contacting a number of service providers. My last choice was to utilize https://infatica.io/scraper-api/ . Working online used to be dangerous and time-consuming, but the procedure is now lot simpler. It's become a lot simpler and more secure.
