4th Anniversary Meetup: Discussion on SEC Crypto Exchange Regulation

On 30 July 2019, we'll celebrate the fourth anniversary of Manila Ethereum Meetup - which also coincides with the fourth anniversary when the Ethereum network launched.

Although most of the network activities happen online, an ecosystem has also germinated offline - organically with the maturing token market; and through the initiatives of blockchain-friendly jurisdictions with their light touch approach and proactive industry engagement. Indeed, "transformative technological changes tend to reward those are prepared to invest ahead ahead of the curve, rather than the ones who wait until new technologies are fully proven and accepted". (Ken Timsit, 2019)

Our panel will discuss the critical role of crypto exchanges as backbone of blockchain-based financial market infrastructures. The subject is of utmost relevance bearing in mind the recently-issued SEC proposed regulation for "Digital Asset Exchanges".

Our panelists will also facilitate the discussions to seek feedback from the audience about the draft rules, and hopefully inspire our community to participate in the consultation exercise by writing formal comments addressed to the SEC.

Some questions that our community will need to reflect on: Is it good policy to regulate crypto exchanges as Self-Regulatory Organization (SRO)? Would it be more sound to treat them as Alternative Trading System (ATS) or will there be no difference? Are the listed "disallowed" exchange activities (Sec.11) commercially realistic? Are the transactions-based additional fees (Sec. 64) too onerous for operators of crypto exchange? Is the investment limitation per user too low or maybe practically ineffective?

How does the SEC framework impact the overall adoption of crypto as a new asset class? Finally, are there alternative approaches to regulation that should be considered by the SEC?
